1. Agreement to these Terms
These Terms of Service (“Terms”) are a legal agreement between you and NOMA App LLC (“NOMA,” “we,” “us”) governing your use of the NOMA app and website (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live) to create an account and to purchase a subscription. By using NOMA you represent that you meet this requirement.
3. Your account
You are responsible for keeping your login credentials secure and for all activity under your account. Provide accurate information and keep it current. Notify us at hello@nomaapp.co if you suspect unauthorized use. You may delete your account at any time in Profile → Delete Account.
4. Subscriptions, billing, and cancellation
NOMA offers free features and an optional paid subscription that unlocks additional quizzes, AI tools, and content.
Current prices and billing periods are shown in the app before you purchase. Prices may change; we will give notice as required and changes will not affect your current paid period.
Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date.
For Apple App Store or Google Play purchases, billing, renewals, and cancellations are managed by Apple or Google — manage or cancel in your App Store or Google Play account settings; deleting the app does not cancel a subscription. For web purchases, processed by Stripe, you can cancel from within the app or by contacting us.
Free trials, if offered, convert to a paid subscription unless canceled before the trial ends. Refunds for in-app purchases are handled by Apple or Google under their policies; for web purchases, refunds are provided where required by law.
5. License to use the Service
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.
6. Your content and uploaded photos
You retain ownership of the photos and content you upload (“User Content”). You grant NOMA a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your User Content solely to provide and improve the Service — including transmitting your photos and prompts to our AI service providers to generate the results you request.
You represent that you own or have the rights to the content you upload and that it does not infringe anyone’s rights or violate any law. Do not upload photos of other people without their consent, or content you don’t have the right to use.
7. AI features and no professional advice
NOMA uses AI to generate style suggestions, room redesigns, layout and floor-plan visualizations, color palettes, and shopping ideas. These outputs are automated suggestions for inspiration only. They may be inaccurate, incomplete, or unsuitable for your space, and are not professional interior-design, architectural, engineering, structural, or contracting advice. Do not rely on AI-generated layouts or plans for construction or safety decisions; consult a qualified professional. You are responsible for any purchases or changes you make.
8. Acceptable use
You agree not to use the Service for any unlawful purpose; upload content that is illegal, infringing, harmful, or that depicts others without consent; reverse engineer, scrape, overload, or gain unauthorized access to the Service or other users’ data; resell or exploit the Service or its content except as permitted; or misuse AI features to generate prohibited, harmful, or infringing content.
9. Intellectual property
The Service — including its software, design, text, graphics, and curated imagery (excluding your User Content and third-party content) — is owned by NOMA or its licensors and protected by intellectual-property laws. We grant you no rights except the license in Section 5. “NOMA” and our logos are our trademarks; do not use them without permission.
10. Third-party links and shopping
The Service contains links to third-party retailers and house-plan sites, some of which are affiliate links from which we may earn a commission. We do not control and are not responsible for third-party sites, products, prices, or content. Your dealings with them are solely between you and the third party.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding the accuracy or reliability of AI-generated results. We do not warrant that the Service will be uninterrupted, secure, or error-free.
12. Limitation of liability
To the maximum extent permitted by law, NOMA and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or related to your use of the Service. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
13. Indemnification
You agree to indemnify and hold NOMA harmless from claims arising out of your User Content, your use of the Service, or your violation of these Terms or the rights of others.
14. Termination
We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination will survive.
15. Governing law
These Terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-law principles.
16. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new date and, where required, provide additional notice. Continued use after changes take effect means you accept the updated Terms.
17. Apple App Store — additional terms
If you download NOMA from the Apple App Store, these Terms are between you and NOMA only, not Apple; Apple is not responsible for the app or its content and has no obligation to provide support or handle warranty claims; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Your use must also comply with the Apple Media Services Terms and App Store Usage Rules.
