• Material preferences and selections you make in the Material Palette Builder
• Referral codes you generate or use

Information Collected Automatically

• Device information (device type, operating system, unique device identifiers)
• App usage data (features accessed, time spent, quiz completion)
• Log data (IP address, app crashes, performance data)
• In-app purchase history (processed by Apple App Store or Google Play — we do not store payment card details)

Photos and Images

When you use AI-powered features that require photo uploads, the image is sent to Anthropic's Claude API for analysis. Photos are processed in real-time and are not permanently stored on our servers. We do not use your photos to train AI models. Please review Anthropic's Privacy Policy at anthropic.com/privacy for their data handling practices.

2. How We Use Your Information

• To provide and improve the App's features and functionality

3. Information Sharing

We do not sell your personal information. We may share information with:

• Anthropic: Photo and text data necessary to generate AI responses through the Claude API
• Apple / Google: Subscription and purchase data as required for App Store / Google Play billing
• Affiliate Partners: We use affiliate links to third-party retailers (Wayfair, Amazon, etc.). When you tap a product link, you may be directed to their site subject to their privacy policies. We receive commissions on qualifying purchases.
• Analytics Providers: Aggregated, anonymized usage data to improve the App
• Legal Requirements: When required by law, court order, or governmental authority

4. Data Storage and Security

Your quiz results, style profiles, and material preferences are stored securely. We implement industry-standard security measures to protect your data. However, no method of transmission over the internet is 100% secure.

Style quiz data and results are stored on Base44's secure infrastructure. Payment processing is handled entirely by Apple App Store or Google Play and we never have access to your payment card information.

5. Data Retention

We retain your account data and style profiles for as long as your account is active. You may request deletion of your account and associated data at any time by contacting us at privacy@nomaapp.co. Upon deletion request, we will remove your personal data within 30 days, except where retention is required by law.

6. Children's Privacy

Noma is not directed to children under the age of 13 (or 16 in the European Union). We do not knowingly collect personal information from children under these ages. If you believe we have inadvertently collected information from a child, please contact us immediately at privacy@nomaapp.co.

Depending on your location, you may have the right to:

If you are located outside the United States, please note that your information may be transferred to and processed in the United States, where our servers are located. By using the App, you consent to this transfer.

11. Push Notifications

We may send push notifications for style refresh reminders and app updates. You can opt out of push notifications at any time in your device settings.

These Terms of Service ("Terms") govern your use of the Noma: Interior Design AI mobile application ("App") operated by Modern Digital Empire LLC ("Company," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Noma, you confirm that you are at least 13 years of age, have the legal capacity to enter into these Terms, and agree to comply with all applicable laws and regulations.

2. Description of Service

Noma is an AI-powered interior design style discovery application that provides:

• Swipe-based room style quizzes to identify your design preferences
• AI-generated style results, material palettes, and design recommendations
• AI-powered photo analysis tools (Room Style Analyzer, Paint Color Identifier, Product Style Checker)
• Curated product shopping recommendations with affiliate links
• Room planning and layout tools

3. User Accounts

You may use certain features of Noma without creating an account. For full access, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscriptions and Billing

Free Tier

The App offers a free tier that includes access to the Living Room style quiz and limited features.

Paid Subscription

Full access to Noma is available through a paid subscription at $7.99/month or $59.99/year. Subscriptions are billed through the Apple App Store or Google Play Store and are subject to their respective billing terms.

Subscription Terms

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• Payment is charged to your App Store or Google Play account upon purchase confirmation
• You may manage or cancel your subscription through your device's App Store or Google Play settings
• No refunds are provided for partial billing periods, except as required by applicable law
• Prices are subject to change with notice

One-Time Purchases

The App may offer one-time purchases (such as the $2.99 single-room unlock). These are non-refundable once the content has been accessed.

5. Refund Policy

All purchases are processed through Apple App Store or Google Play. Refund requests must be submitted directly to Apple or Google through their standard refund processes. We do not process refunds directly. Apple and Google's refund policies apply to all purchases made through their respective stores.

6. AI-Generated Content

Noma uses artificial intelligence (Anthropic's Claude) to generate style results, material descriptions, design recommendations, and photo analyses. You acknowledge that:

• AI-generated content is for inspiration and informational purposes only
• Style results and recommendations are based on your quiz responses and may not reflect professional interior design advice
• AI analysis of photos is probabilistic and may not be perfectly accurate
• We do not guarantee that AI recommendations will meet your specific needs or expectations
• Paint color matches identified by AI are approximations — always verify with physical samples before purchasing

7. User Content and Photo Uploads

By uploading photos to the App, you:

• Grant us a limited license to process those photos using AI for the purpose of providing the requested service
• Confirm you have the right to share the images (i.e., photos taken by you or images you have rights to use)
• Understand that photos are sent to Anthropic's API for processing and are not permanently stored by us
• Agree not to upload photos containing personal information of others without their consent
• Agree not to upload illegal, harmful, or offensive content

8. Affiliate Links and Third-Party Products

The App contains affiliate links to third-party retailers. When you make a purchase through these links, we may receive a commission. We are not responsible for the products, services, pricing, or policies of third-party retailers. Any transactions between you and third-party retailers are solely between you and that retailer.

Product recommendations are generated based on your style profile and are not endorsements. We make no warranties regarding the quality, suitability, or availability of recommended products.

9. Intellectual Property

The App, including its design, features, content, and AI-generated outputs provided to you through the App, are owned by or licensed to Modern Digital Empire LLC. You may not reproduce, distribute, or create derivative works from any App content without our express written permission.

Your style quiz responses and uploaded photos remain your property. By using the App, you grant us a limited license to use this data to provide and improve the service.

10. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract the App's source code
• Use automated tools to access or scrape the App
• Upload malicious content or attempt to compromise the App's security
• Resell or sublicense access to the App
• Use the App to generate content that is harmful, offensive, or violates third-party rights

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. AI-GENERATED CONTENT IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE PROFESSIONAL INTERIOR DESIGN ADVICE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MODERN DIGITAL EMPIRE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO RELIANCE ON AI-GENERATED DESIGN RECOMMENDATIONS, PRODUCT PURCHASES MADE THROUGH AFFILIATE LINKS, OR LOSS OF DATA.

13. Indemnification

You agree to indemnify and hold harmless Modern Digital Empire LLC from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

14. Termination

We reserve the right to terminate or suspend your account at our discretion if you violate these Terms. Upon termination, your right to use the App ceases immediately. Subscription fees paid prior to termination are non-refundable unless required by law.

15. Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Utah County, Utah.

16. Changes to Terms

We may update these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
